"Battalion Vienna": the SBI will examine (check) the legality of crossing the state border by the figurants of journalistic investigation (VIDEO)

The SBI employees will check the information of journalists, presented in the second part of the investigation of "Ukrainska Pravda" regarding the departure abroad during the russian aggression of the citizens of Ukraine liable for military service.

In particular, within the framework of the investigation of the criminal proceeding initiated after the publication of the first part - "Monaco Battalion", the circumstances of crossing the state border of Ukraine by the persons involved in the new investigation - "Vienna territorial defense", as well as the role and place of law enforcement officials in this process, will be investigated.

At the same time, the State Bureau of Investigation would like to remind that the pre-trial investigation has been initiated concerning the fact of organization by law enforcement officers and civilians of the illegal border crossing of one of the defendants in the "Vienna terrorist defense", that is an ex-judge and former Chairman of the Constitutional Court of Ukraine Oleksandr Tupytskyi.

During the pre-trial investigation, the SBI investigators established that he crossed the border of Ukraine without passing the required border and customs control and without checking the documents granting the right to travel abroad. Also, the existence or absence of any grounds for temporary restriction of Tupytsky's right to travel abroad was not established.

The investigation recorded the fact that Tupytsky was staying in Austria in the center of Vienna along with a car registered to his wife.

However, according to the State Border Guard Service, Tupytsky did not legally cross the state border of Ukraine.

The investigation in the criminal proceeding over a criminal offense under Part 2 of Art. 332 of the Criminal Code of Ukraine is ongoing.

All circumstances of the offense and all persons involved in the illegal transportation of Tupytsky across the state border of Ukraine are being established in order to bring them to criminal responsibility.
