On April 25th 2023, a number of media outlets disseminated information about the SBI's alleged assistance to aggressor state representatives in re-registering in their favour the Ukrainian enterprise Kyivmisksantekhmontazh ALC.
We would like to inform you that this information is untrue, it misrepresents the actual state of events and is designed to sway the course of the investigation in the interests of certain individuals.
In fact, following the private notary's application, the SBI is conducting a pre-trial investigation into the alleged threats to her from law enforcement officials demanding that she would not take any actions regarding the revealed facts of property alienation (part 2 of Article 365 of the Criminal Code of Ukraine).
The company, Kyivmisksantekhmontazh ALC, is located in the centre of Kyiv, near elite new buildings
In the course of the investigation, it was established that a resident of Luhansk region, a citizen of Ukraine, applied to the notary to re-register the property using "powers of attorney" from two co-owners of the company. On the basis of the available documents, the notary started a registration procedure to change the owners of the property complex. In the process, the head of the company was changed to a native and resident of Luhansk region.
Later, the previous owners applied to the Ministry of Justice, claiming that they had not issued any powers of attorney for the registration actions. Following consideration of the appeal, the Ministry of Justice cancelled the notary's deeds and Kyivmisksantekhmontazh ALC is presently owned by the former owners again.
Therefore, this proceeding does not involve a representative of the aggressor country, but the legality of the change in the organisational form of ownership of Kyivmisksantekhmontazh OJSC, the legality of the notary's actions and the legitimacy of the powers of attorney issued are being examined.
The criminal investigation is ongoing. All lawbreakers will be brought to justice.
