The Former Head of the Constitutional Court of Ukraine and law enforcement officers, who transported him abroad, were served notifications of suspicion

According to the materials of the investigation of the State Bureau of Investigation, the prosecutor has served notifications of suspicion to the Former Head of the Constitutional Court of Ukraine, as well as an employee of the State Border Guard Service of Ukraine and the Deputy Head of one of the district departments of the law enforcement agency in the west of Ukraine.

The SBI, in cooperation with the Administration of the State Border Guard Service of Ukraine, the Department of Internal Security of the National Police of Ukraine and the Security Service of Ukraine, collected evidences of the involvement of the defendants in organizing the illegal transfer of citizens across the state border of Ukraine.

Among others, the law enforcement officer created an organized group that was transporting persons liable for military service across the state border and looked for those who wanted to use their services.

To do this, he had hired a driver, who was transporting those men outside Ukraine by car through checkpoints where members of this group were working.

He personally controlled that the border guards let those cars pass without checking the documents of the passengers and inspecting the vehicle. Instead, only the documents of the driver were checked, and only his personal data was entered into the database of persons, who crossed the state border of Ukraine.

Beyond the checkpoint, the driver got out of the car, transferred control of the car to a person whom he had just illegally transferred from Ukraine, and then returned back to Ukraine on foot, where he received a reward from the law enforcement officer.

At the same time, the car with illegally transported citizens of Ukraine drove further and officially entered the neighboring state.

Under this scheme, in March 2022, the former Chairman of the Constitutional Court of Ukraine left Ukraine in order to hide from criminal liability for a number of crimes in the field of justice.

Meanwhile, he facilitated the illegal crossing of the border for two more citizens who were with him in the car at that time.

According to the results of international legal cooperation, the information was received from Hungarian law enforcement agencies regarding persons who, in this way, without passing border and customs control in Ukraine, officially entered this state.

The former Chairman of the Constitutional Court of Ukraine was served notification of suspicion of illegal transfer of citizens across the state border by prior conspiracy by a group of persons (Part 2 of Article 332 of the Criminal Code of Ukraine), and the law enforcement officer and border guard under Part 3 of Article 332 of the Criminal Code of Ukraine.

The pre-trial investigation continues, measures to select preventive measures to the suspects and bring other persons to criminal responsibility are being taken.
