The SBI completed an investigation of the proceedings on the shooting of the employees of the National Guard at the Pivdenmash plant in Dnipro (VIDEO)
The SBI completed a pre-trial investigation against a serviceman who committed shooting at the Southern Machine-Building Plant ("Pivdenmash") in Dnipro in january this year.
The indictment was sent to court.
According to the investigation, the accused, after being called up for military service, faced non-statutory relations from senior colleagues. Several times he witnessed conflicts and quarrels, which he reported to the management. Because of such reports, other servicemen formed a negative attitude towards him.
A few hours before the tragedy, while being on guard duty, the soldier was supposed to rest, but received an order to organize the documentation in the guardroom.
He took this order from a senior soldier as a mockery, and then decided to take revenge for all previous insults. While in the weapons storage room, he took an assault rifle and ammunition and began to brutally shoot, as he believed, all his offenders.
As a result of the incident, 5 people were killed, including one civilian, and 5 others sustained injuries of varying severity.
After the massacre, the accused took an assault rifle and 200 rounds of ammunition and tried to escape. A few hours later he was detained in the town of Pidhorodne, Dnipro district.
Thus, the National Guard officer is accused of violating the statutory rules of relations between servicemen in the absence of subordination, committed against:
- several persons, with the use of weapons, which caused grave consequences (Part 3 of Art. 406 of the Criminal Code of Ukraine)
- premeditated murder (paragraphs 1, 8, 9 of Part 2 of Article 115 of the Criminal Code of Ukraine);
- completed attempted premeditated murder of two or more persons, a person in connection with the performance of his/her official duty, as well as with the aim of concealing another crime or facilitating its commission (Article 15, part 2, paragraphs 1, 8, 9, part 2, Article 115 of the Criminal Code of Ukraine);
- theft by a serviceman of weapons, ammunition, other military property committed under conditions of a special period, except for martial law (Part 3 of Article 410 of the Criminal Code of Ukraine)
- desertion (Part 3 of Article 408 of the Criminal Code of Ukraine);
- violation of the statutory rules of guard service, which entailed grave consequences, for the prevention of which the guard was appointed, committed in conditions of a special period, except for martial law (Part 2 of Article 418 of the Criminal Code of Ukraine);
- unlawful handling of weapons, i.e. carrying and storage of firearms and ammunition without a permit provided by law (Part 1 of Article 263 of the Criminal Code of Ukraine).
The sanctions of the articles provide for punishment in the form of life imprisonment.
Procedural guidance is provided by the Dnipro Specialized Prosecutor's Office in Military and Defense Sphere of the Southern Region.
At the same time, the State Bureau of Investigations registered a criminal proceeding on the fact of official negligence and inaction of officials of the National Guard of Ukraine immediately after the tragedy.
Currently, the examinations in this criminal proceeding are ongoing, and after their completion, the SBI will provide a legal assessment of all those who allowed the tragedy so that similar cases do not happen in the future.
