The SBI served notifications of suspicion to four soldiers from Kyiv region, who refused to execute a combat order
The employees of the State Bureau of Investigation served notifications of suspicion to four soldiers who, under martial law, deliberately refused to execute a combat order of their commanders.
It was established, that at different time, the soldiers of one of the units located in Kyiv region, despite being fit and proper for service, refused to go to the area of fighting. As opposed to their counterparts, who complied with the order, these soldiers deliberately and openly ignored the order, acting contrary to the current legislation.
The State Bureau of Investigation emphasizes: the obligation to protect the independence and territorial integrity of Ukraine is enshrined in Article 65 of the Constitution of Ukraine. Persons, who are evading this duty, as well as those, who commit other war crimes, will be responsible regardless of their position or military rank.
All four defendants were served notifications of suspicion under Part 4 of Article 402 of the Criminal Code of Ukraine - disobedience committed under martial law - and taken into custody.
The sanction of the article provides for imprisonment for up to 10 years.
