The SBI handed over to the law enforcement officers of Poland the criminal case of the Former Head of the State Road Agency of Ukraine, who was detained in Poland for other violations

The employees of the SBI under the procedural guidance of the Office of the Prosecutor General have sent to the Republic of Poland criminal proceeding against the Former Acting Head of the State Road Agency of Ukraine.

Ukrainian law enforcement officers in petition asked Polish colleagues to take over the criminal prosecution of a citizen of their country, who did not comply with the decisions of Ukrainian courts and left state.

He is suspected of intentional failure by an official holding a particularly responsible position to comply with court decisions and rulings that have entered into force, and obstruction of their execution (Part 3 of Article 382 of the Criminal Code of Ukraine).

During 2017-2019, the official deliberately was not complying with the decisions of the local and Supreme courts of Ukraine regarding the reinstatement of the Head of the Road Service in one of the regions and actively obstructed justice.

Because of that, fines were imposed on the State Road Agency of Ukraine, and the Former Head of the State Road Agency of Ukraine was warned of the criminal liability for ignoring court decisions.

At the beginning of September 2019, the enforcement proceeding was completed and the notification of the criminal offense was sent to the law enforcement agencies. On September 30, 2019, the official terminated his powers of his own will, left the borders of Ukraine and returned to the Republic of Poland, on the territory of which he was detained for committing a number of serious corruption criminal offenses.

Due to the presence of grounds, that makes it impossible to extradite the official, the State Bureau of Investigation, on the basis of the agreement from 1993 between Ukraine and the Republic of Poland on legal assistance and legal relations in civil and criminal cases, applied for the adoption of criminal prosecution. The case materials were handed over in accordance with the established procedure.

The sanction of the Article provides for imprisonment for up to 8 years.
